These general terms and conditions of sale (T&Cs) apply to all sales concluded on the website with consumers. Sales to businesses are governed by the Business T&Cs. The applicable version is the one in force on the date of the order.
Sales restricted to adults. The products are intimate wellness items intended for adults. By placing an order, the customer certifies that they are at least 18 years old.
Article 1 – Products and prices
1.1 The essential characteristics of the products (dimensions, material, firmness, colors) are shown on each product page. As the products are hand-cast, slight variations in shade or dimensions may occur.
1.2 Prices are shown in euros including all taxes (VAT included), excluding shipping costs. Shipping costs are shown before the order is confirmed. Shipping is free on purchases from €59 to a Mondial Relay pickup point in France, from €149 for home delivery in France, and from €99 to a pickup point in the European Union countries served, under the conditions displayed before the order is confirmed.
1.3 Products are invoiced at the price in force when the order is confirmed.
1.4 Retention of title: the products remain the property of the seller until the price has been paid in full.
Article 2 – Orders
2.1 The order is concluded when the customer confirms their cart, accepts these T&Cs and makes the payment. A confirmation email summarizing the order is sent to them. For any order of €120 or more, the seller keeps the written record of the contract for 10 years and makes it available to the customer. The contract is concluded in French.
2.2 100% custom creations (from a scan, a 3D file, photos or a sketch): a 50% deposit is paid when ordering; the balance is payable after approval of the 3D preview, via the payment link sent by email. If the project does not go ahead before modeling has started, the deposit paid is converted into store credit valid across the whole site; once modeling has started, it is retained by the seller.
2.3 Files and objects provided by the customer: the customer warrants that the files, photos, scans or objects they provide do not reproduce a protected model, design or trademark belonging to a third party and, for a body scan, that the person scanned has given their consent. The seller reserves the right to refuse any project reproducing a protected or branded design; in that case, the deposit paid is refunded or, at the customer’s choice, converted into store credit. The customer remains solely responsible for the materials they provide.
Article 3 – Payment
Payment is due when ordering. Accepted methods: bank card (CB, Visa, Mastercard), Apple Pay and Link via our secure payment provider, Klarna installment payments (subject to acceptance by Klarna), bank transfer, and payment on site when collecting from the workshop. For bank transfers, the order goes into production or is shipped once the funds are received; if no payment is received within 7 days, it is canceled.
Article 4 – Delivery
4.1 Shipping methods, lead times and rates are shown before the order is confirmed. Parcels are shipped Monday to Friday in plain, discreet packaging with no You&Me branding. Unless otherwise stated on the product page, in-stock products are shipped within 24 to 72 business hours; made-to-order products are shipped within the lead time shown on the product page or in the order confirmation email. If no date is given, delivery takes place no later than 30 days after the order.
4.2 The customer is responsible for the accuracy of their details. If a parcel is returned to the sender because of an incorrect address or because it was not collected from the pickup point, re-shipping costs are borne by the customer.
4.3 The risk of loss or damage passes to the customer when they take physical possession of the products. We invite customers to check their parcel on delivery and to report any missing or damaged product within 48 hours, with photos, to contact@youandme-frenchtoys.com, so that we can speed up the claim with the carrier.
4.4 If a product becomes unavailable after the order, the customer is informed and refunded within 14 days, unless they prefer to wait for restocking or receive store credit.
4.5 Deliveries outside the European Union: any import duties and taxes are payable by the recipient. Some countries restrict the import of erotic items: it is the customer’s responsibility to check the regulations in their country.
Article 5 – Right of withdrawal
5.1 The customer has 14 days from receipt of the products to withdraw from the contract without giving any reason, by sending us a clear statement (email or the model form below), then returning the products no later than 14 days after that statement. Return costs are borne by the customer.
5.2 Exclusions (Article L221-28 of the French Consumer Code) :
- sealed goods unsealed after delivery that are not suitable for return for health protection or hygiene reasons: all our intimate toys are delivered in sealed packaging; once the seal is broken, the right of withdrawal no longer applies;
- goods made to the customer’s specifications or clearly personalized: each toy is made to order as a one-off piece, according to the combination chosen by the customer (model, size, color or two-tone, firmness, finish, Vac-U-Lock option); it is not taken from stock and cannot be resold. The same applies to custom creations based on a model supplied by the customer. Products marked “In Stock” on the site remain subject to the right of withdrawal, subject to the hygiene seal.
5.3 All sums paid, including initial shipping costs (based on the cheapest standard shipping method), are refunded no later than 14 days after receipt of the withdrawal statement. The refund may be withheld until the products have been received or proof of their return has been provided. It is made using the same payment method as the order, unless the customer agrees to another method. The customer may be held liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature and characteristics.
5.4 Withdrawal form (complete and return only if you wish to withdraw): To CS Engineering – You&Me FrenchToys, Avenue Maurice René Simonet, ZAC Briffaut, 26000 Valence, France – contact@youandme-frenchtoys.com: I hereby give notice that I withdraw from my contract for the sale of the following goods: […] – Ordered on […] / received on […] – Consumer’s name: […] – Address: […] – Signature (if sent on paper) – Date: […].
Article 6 – Statutory warranties
6.1 All products are covered by the statutory warranty of conformity (Articles L217-3 to L217-20 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code), at no cost to the customer.
6.2 Legal notice box – statutory warranty of conformity and hidden defects (official text from the annex to French Decree no. 2022-946 of June 29, 2022 – English translation for information):
The consumer has two years from delivery of the goods to obtain the implementation of the statutory warranty of conformity if a lack of conformity appears. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the statutory warranty applies to that digital content or service throughout the planned supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared.
The statutory warranty of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair but the seller imposes replacement, the statutory warranty of conformity is renewed for two years from the date of replacement of the goods.
The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund upon return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement takes place after a period of thirty days;
3° The repair or replacement causes major inconvenience for the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining warranty period until the goods are returned in working order.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the implementation of the statutory warranty of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.
6.3 These statutory warranties apply independently of any commercial warranty.
6.4 To make a warranty claim: contact@youandme-frenchtoys.com or by post to CS Engineering, Avenue Maurice René Simonet, ZAC Briffaut, 26000 Valence, France. Return costs for a defective product are borne by the seller.
6.5 Damage caused by use not in accordance with the instructions does not constitute a lack of conformity: silicone-based lubricant, prolonged contact with other silicone toys, exposure to a heat source, sharp objects, animal bites, harsh cleaning products.
Article 7 – Liability
The seller is not liable for non-performance of the contract attributable to the customer, a third party or force majeure. Links to other websites do not make the seller responsible for their content.
Article 8 – Personal data
The processing of customers’ personal data is described in the privacy policy. Customers have the right to access, rectify, erase and object to the processing of their data by contacting contact@youandme-frenchtoys.com.
Article 9 – Intellectual property
The texts, photos, models, shapes and designs of the products, as well as the You&Me brand, are protected. Any full or partial reproduction without written permission is prohibited.
Article 10 – Customer service, mediation and disputes
10.1 Customer service: contact@youandme-frenchtoys.com – +33 7 56 80 83 27 – CS Engineering, Avenue Maurice René Simonet, ZAC Briffaut, 26000 Valence, France.
10.2 If a dispute is not resolved after a written complaint to customer service, the customer may refer it free of charge to the consumer mediator: CM2C – 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net – online submission: cm2c.net/declarer-un-litige.php – email: declarer-un-litige@cm2c.net (Articles L.612-1 et seq. of the French Consumer Code).
10.3 These T&Cs are governed by French law. Failing an amicable settlement, disputes fall within the jurisdiction of the competent French courts; the consumer may bring proceedings before the court of their place of residence.
